HENDERSON, NY — Devyn R. Haertling, 21, Fort Drum, was charged by state police at 10:55 p.m. Monday, Sept. 3, at Trolley’s Ice Cream, 8355 Route 3, Henderson, with aggravated driving while intoxicated following a reported property damage accident.
A blood alcohol content of 0.08 percent or more is considered proof of intoxication under state law. Aggravated DWI, which carries harsher penalties upon conviction, is charged when the BAC is 0.18 percent or greater. Troopers did not provide his BAC.
He is summoned to appear in Henderson Town Court.
