WATERTOWN, NY — Jovan D. Martinez, 22, of 8211 S. Lewis Ave., Apt. A, Fort Drum, was charged by Watertown police at 1:04 a.m. Friday, Feb. 15, in the 100 block of S. Massey Street with aggravated driving while intoxicated, failure to keep right and two counts of failure to obey a traffic control device.
His blood alcohol content was 0.18 percent, police said. A BAC of 0.08 percent or more is considered proof of intoxication under state law. Aggravated DWI, which carries harsher penalties upon conviction is charged when the BAC is 0.18 percent or greater.
He was released to military custody and summoned to a appear Feb. 27 in City Court.
