LeRay man’s BAC was 0.24% during traffic stop, deputies say

EVANS MILLS, NY — James R. Kidney, 29, of 25965 Little Owl Court, Evans Mills, was charged by Jefferson County sheriff’s deputies at 11:23 p.m. Saturday, Dec. 8, at 25744 Route 11 in the town of LeRay with aggravated driving while intoxicated and failure to obey a traffic control device.

His blood alcohol content was 0.24 percent, deputies said. A BAC of 0.08 percent or more is considered proof of intoxication under state law. Aggravated DWI, which carries harsher penalties upon conviction, is charged when the BAC is 0.18 percent or greater.

He is ordered to appear Jan. 7 in LeRay Town Court.
