Lowville man charged with aggravated DWI, deputies say

LOWVILLE, NY —   Cody M. Cannon, 27, of 6646 Tillman Road, Lowville, was charged by Lewis County sheriff’s deputies at 12:27 a.m. Monday, Jan. 13, at 5403 Shady Ave. in Lowville with aggravated driving while intoxicated and unsafe backing.

Deputies responded to a report of a disturbance in a parking lot behind Shady Avenue in Lowville.

“Upon arrival, a sheriff’s deputy located Cannon standing at the open door of his vehicle and was advised he had just backed into another vehicle which had been parked behind him to prevent him from driving away after witnesses believed he was intoxicated,” deputies said.

His blood alcohol content was 0.23 percent, deputies said. A BAC of 0.08 percent or more is considered proof of intoxication under state law. Aggravated DWI, which carries harsher penalties upon conviction is charged when the BAC is 0.18 percent or greater.

He is summoned to appear in Lowville Village Court at a later date.

Deputies were assisted at the scene by NY State Police.
