NC man facing DWI, weapon charges

WATERTOWN, NYJames J. Hanyak Jr., 50, of 1616 Mackerel Lane, Carolina Beach, NC, was charged by Watertown police at 8:04 p.m. Sunday, May 26, at 1050 Arsenal St. with driving while intoxicated, refusal to take a breath test, and third-degree aggravated unlicensed operation. He was also charged with felony counts of third-degree criminal possession of a weapon, third-degree criminal possession of a weapon – ammo clip, and third-degree criminal possession of a weapon – previous conviction.

Police allege he possessed a KEL-TEC P3AT handgun without a valid NYS pistol permit and has a prior misdemeanor conviction on November 2004 in Orleans Town Court.

He also allegedly possessed a .223 Bushmaster XM15-E2S with a collapsible stock, pistol grip, forward grip, flash suppressor and a bayonet mount, police said. “The firearm was located beneath the rear seat of the vehicle owned and operated by the defendant,” according to court documents.

A blood alcohol content of 0.08 percent or more is considered proof of intoxication under state law. Police said he refused a breath test to determine his BAC.

He was being held at the Metro-Jefferson Public Safety Building pending arraignment Monday morning in City Court.
