Watertown woman’s BAC was 0.25 percent, police say

WATERTOWN, NYPenny A. Smith, 50, of 319 Academy St., Watertown, was charged by Watertown police at 6:42 p.m. Monday, April 1, in the 1600 block of State Street with aggravated DWI, felony DWI, refusal to take a breath test and leaving the scene of a property damage accident.

Her blood alcohol content was 0.25 percent, police said. A BAC of 0.08 percent or more is considered proof of intoxication under state law. Aggravated DWI, which carries harsher penalties upon conviction, is charged when the BAC is 0.18 percent or greater.

She is accused of operating a white 1996 Saturn west in the 1700 block of State Street at about 6:05 p.m. while in an intoxicated condition and with a previous DWI conviction on Oct. 13, 2011, in Pamelia Town Court, according to court documents.

Police did not provide details about the property damage accident.

She is summoned to appear April 17 in City Court.
